jquery include charset and IE9

just ran into a weird problem where IE9 did not like the "latest jquery.com include" it only works with [script src="https://ajax.googleapis.com/ajax/libs/jquery/1.6.2/jquery.min.js" type="text/javascript" charset="utf-8"]
