While the shift to a virtual workspace has reportedly resulted in a decrease in the total number of women harassment act complaints in India, sexual harassment still occurs in more subtle ways, such as inappropriate messages, calls/texts at odd hours, sexist remarks, and taking screenshots without one's knowledge during video calls, among other things. Due to the lockdown in place since March 2020, matters under the Posh Law have been heard through video conferences and decisions have been issued digitally, bearing the urgency and seriousness of the situation in mind.
WHAT IS “sexual harassment of women at workplace act”?
The Kerala High Court affirmed the standards established in its prior decision, stating that sexual harassment at work should begin with an express or implicit sexual approach or unwelcome behaviour with a'sexual' tone. The requirements of the women harassment act will not apply if the behaviour does not have a'sexual' tone to it. The court further noted that the Posh Law's term sexual harassment is an inclusive definition, meaning that any other sort of sexual treatment or sexual behaviour can be covered by the law.
